But I checked with a colleague who worked at my insurance provider in claims, and the thought is that this is probably going to get tossed out...

I'm probably out my deductible... <<owtch>> but the end result will be better than a Galactor strike.

Like KT, I think the guy should be happy to be still alive! You have to remember, our society is leaning towards no one being responsible for their own actions. Look at the ruling in Texas on the 16 year old kid who drove drunk, killed 4 people in a crash and got off because the defense said his family is so rich they weren't capable of teaching him right from wrong. The judge agreed.

That motorcyclist should be thanking his lucky stars he's alive and commit his lack of control to the school of hard knocks - don't ride so close to the car in front of him.

The kid in Texas was sentenced to spend two years at a special school in California that costs $450K, yep $450,000 a year for two years and has to eat organic food.

That's a real punishment.

If the claim from the motorcycle rider does go on, Boeke, you could counter sue him for emotional trauma - you can say you're now afraid to drive near motorcyclists for fear they're too stupid to keep a proper distance from your car and pay attention to what's happening in front of them.

What is it about bad things happening in threes?????

#2 - my Mom's laptop popped a motherboard on the second day of their stay with us....
#3 - the air handler/heating unit in the guest area failed (completely shorted out) on the night the Floridian temperatures reached into the 40's.... and my parents (thankfully with good humor) had to face an extra layer of blankets... (it is now fixed... with an infusion of cash)

SHEESH!!!

Hope I attracted all the bad news for this holiday season!

Boeke, I should think you've had enough bad luck to last through next year. Hope things improve. You could also sue the motorcyclists for the cost of your deductible, but unfortunately that just contributes to the sue happy nature of our society.

I read about the Texas case. What is worse, is I've read the same judge gave much harsher sentences to poor, black kids whose offense was less. So it is not just about personal responsibility, but it is also racists. To contradict what I said about our sue happy nature, I hope the boy's family lose everything in the civil lawsuits that are coming against both his parents and their company; he was driving a company truck at the time.

Well...

I (finally) have my car back from the repair shop - there was more damage than originally estimated and the insurance company randomly selected it for an audit.

Still out my deductible and the co-payment on the rental car.

No news from the adjustor on the state of the other party... or whether I'll get any of my deductible back in the future - or whether it will hit my insurance in higher premiums!

2014 must be better...

More on the saga.... at least vehicle-wise...

I did get my car back on Saturday (4 weeks!), and when getting on the road to work on Monday, I noticed that I could not open the trunk from the remote... and a couple of other computer-related quirks. Lonig story short - since the rear panel needed a complete replacement (as well as assorted connectors, trunk and bumper pieces, and the splash guard assembly... Sheesh! Who woulda thunk a motorcycle could pack such a whallop), the repair shop at the dealership needs a half day to reset and recalibrate all the eletronic systems....

Would you not have assumed this would be done BEFORE they returned and released the car?...

Still - having it back is comforting. Just.... BLEEP!

You just have to be patient, Boeke! What else could you do!? We have a saying, here ... when it comes, just let it in! At least, it seems that, hopefully, everything should be solved in the very near future! Huggles Ah ... when it comes to problems in car electronics, thiings become more complicated ... the more the car has, the more the issues when they start to tease!

Welp...

Took the car in this morning, for what was supposed to take 4 hours... and ended up with a rental for at least tomorrow, if not Wednesday as well.

At least the collision repair shop is covering the additional cost for not checking all the notes.

Still haven't heard "peep" from the insurance company since the day after the encounter.
